Tuesday, September 9, 2025, TANNERSVILLE, PA, — PennFuture reached a settlement agreement in its case appealing the stormwater management permits issued by the Pennsylvania Department of Environmental Protection (DEP) to Core 5 Industrial Partners, LLC. As a result of this settlement, Core 5 agreed to make certain improvements on its design, to better protect and maintain the existing Exceptional Value wetlands at the site. These wetlands, which are part of the High Quality Pocono Creek watershed, are entitled to special protections under state law.
PennFuture also secured an agreement with the DEP to roll out a statewide update to the DEP Post-Construction Stormwater Management (PCSM) Spreadsheet Instructions, making changes to provisions related to street sweeping credits, which will ensure that future projects across the state will not be overcredited for street sweeping as a means of sediment control, keeping Pennsylvania up to date with both best practices applied throughout the region and the Department’s own research.
The case is Citizens for Pennsylvania’s Future v. Dep’t of Env’t Prot. & Core 5 Industrial Partners, LLC, EHB Docket No. 2025-011-L.
