
The strip mine is one part of a plan to develop this wooded area. It contains 6 unnamed streams, areas of mature cherry and walnut trees and rolling meadows which honor the legacy of the Hays Farm. A network of trails have developed due to the forest’s constant use by visitors and resident wildlife. The forest supports year round activities including hiking, bird watching, trail biking, cross-country skiing and hunting.
The proposed action would be the first instance of the Department of Environmental Protection (DEP) approving the valley fill of streams with spoil to accommodate a strip mine. PennFuture filed objections to the permit.
On December 21, 2006, DEP denied the permit, preserving Hays Woods, for a time.
The developer appealed the permit denial to the Environmental Hearing Board. PennFuture intervened in the appeal to support DEP s denial.
SUCCESS!
On May 21, 2009 the Environmental Hearing Board upheld DEP's permit denial and stated that mining operations may not harm Pennsylvania's streams and rivers. Hays Woods is protected! Read PennFuture's press release here.
